Acceptance of the terms and conditions

Entire Agreement:

These Terms, together with any specific contract you enter into with Gorigami, constitute the entire agreement between you and Gorigami regarding the Services and supersede any prior agreement, oral or written, relating thereto.

Description of services

Scope of Services:

Gorigami offers a variety of services including, but not limited to, custom landing page creation, robust website development, e-commerce design and development, and custom software development. The exact scope of the Services and specific features will be detailed in a separate contract entered into between Gorigami and the client.

Technology Selection:

Gorigami is committed to using technologies and tools appropriate to the project, taking into account budget, available infrastructure, and the complexity of the service. Our priority is to provide the best possible solution for each client, which may involve selecting specific technologies suited to their needs and objectives.

Focus on Excellence:

Our commitment is to deliver high-quality services that meet industry standards and exceed our clients’ expectations. We will always strive to use the most suitable and effective technologies to ensure your project’s success.

Customization:

We understand that every project is unique, and we will strive to customize our Services according to your individual requirements. We will work with you to understand your specific goals and objectives and develop solutions that fit your needs.

Detailed Contract:

Before starting any project, Gorigami will provide a detailed contract specifically describing the services to be provided, the technologies to be used, and any other relevant details. This contract will be mutually agreed upon and signed by both parties before work begins.

During project development, Gorigami will maintain open and transparent communication with you, providing regular updates on progress and any changes in approach or technologies used.

Intellectual property rights

Gorigami’s Ownership:

All intellectual property rights related to the services provided by Gorigami, including but not limited to copyrights, trademarks, and patents, are and will remain the exclusive property of Gorigami. Nothing in these Terms grants the client any ownership right over such intellectual property, except to the extent necessary to receive the Services.

Third-Party Technologies:

In some cases, Gorigami may use third-party technologies, such as content management systems (CMS) like WordPress or other tools and platforms for website creation. In such cases, the intellectual property rights associated with those technologies will remain the property of their respective creators or owners, in accordance with the licenses and terms of use provided by those third parties. The client agrees that Gorigami has no control over the intellectual property rights of the third-party technologies used and that their use is subject to the policies and terms of the respective providers of those technologies.

Usage Licenses:

Gorigami will grant the client a non-exclusive, non-transferable license to use the final result of the Services, including the website, landing page, or software developed as agreed in the contract. This license is limited to using the final result for its intended purpose and does not grant any additional intellectual property rights over individual project elements that may be subject to third-party rights.

Payment and Billing

Fees and Budgets:

Fees for Services provided by Gorigami will be determined by mutual agreement between both parties and set out in a separate contract. The client will receive a detailed budget including all fees, additional costs, taxes, and any other relevant charges.

Taxes:

Gorigami will comply with all applicable tax obligations in Colombia. Agreed fees may be subject to local, state, or national taxes. The client will be responsible for paying any additional tax that applies under Colombian tax law.

Payment Methods:

Gorigami accepts the following payment methods, subject to regulations and policies in effect in Colombia:

Bank transfer
Credit or debit cards
Other payment methods agreed upon in the contract

Withholding Tax:

In Colombia, tax regulations may require the client to withhold tax on payments made to Gorigami in accordance with the agreed fees. The client agrees to comply with all withholding tax obligations established by Colombian tax law.

Payment Default:

In the event of default on payment of agreed fees, Gorigami reserves the right to suspend or cancel the Services until the corresponding payment is made.

Cancellation and refund policy

The cancellation and refund policy will be established in the contract between Gorigami and the client.

Limitation of liability

To the extent permitted by applicable law, Gorigami will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our Services.

Modifications to these terms

We reserve the right to modify these Terms at any time. Modifications will take effect once published on our website. Clients are encouraged to regularly review these Terms to stay informed of any changes.
